Copyright & Intellectual Property Policy
Last updated: 27-12-2025
All content on https://www.webzenith.tech is the intellectual property of Webzenith Solutions unless otherwise stated.
1. Who we are
Webzenith Solutions (“Webzenith”, “we”, “us”) is a partnership firm registered and operating from Chennai, Tamil Nadu, India. This Copyright & Intellectual Property Policy explains how copyright and other intellectual property rights on https://www.webzenith.tech (the “Website”) and in connection with our services are handled.
2. Scope
This policy applies to:
- All content published on the Website (text, images, graphics, case studies, videos, downloadable materials);
- Portfolio and marketing materials;
- Deliverables created for clients (designs, apps, software, code snippets), subject to the terms of the client agreement, proposal, or Statement of Work (SOW).
3. Copyright notice
© Webzenith Solutions. All rights reserved. Unless otherwise indicated, all content on this Website is the copyrighted work of Webzenith and may not be copied, reproduced, or republished without prior written consent. (Sample copyright notices and best practices referenced).
4. Works covered
Protected works include, but are not limited to: website copy and blog posts; marketing collateral; logos, icons and images; UI/UX and design files; source code, software, and software libraries developed by Webzenith; audiovisual content; and client case studies. The Copyright Act, 1957 protects original works, including software and website content.
5. Client deliverables & ownership
- Deliverable ownership is governed by contract. Ownership, assignment, and license terms for client deliverables are set out in the applicable proposal, SOW, or client agreement.
- Default position: Unless your contract expressly assigns copyright to the client, Webzenith retains ownership of pre-existing code, frameworks, libraries, templates, and reusable components (“Background IP”), and grants the client a license to use deliverables for the agreed purpose.
- If you require a full transfer of copyright, that must be agreed in writing and may require additional fees. This prevents accidental over-assignment of Webzenith’s reusable assets.
6. White-label & portfolio usage
- Webzenith frequently works on white-label engagements. Where a contract requires confidentiality or protects a client’s identity, we will not disclose client identities or sensitive deliverables publicly.
- For non-confidential projects, Webzenith may display work in its portfolio, referencing the client by name or logo only with client consent. For white-label projects, we use anonymized descriptions or placeholders unless the client provides explicit permission to be named. Maintain explicit written consent (email or clause in the contract) before publishing a case study. (Agency/white-label best practice.)
7. Third-party materials & open-source components
- Our deliverables may include third-party materials or open-source components. Such components are used in accordance with their licenses. Clients are responsible for complying with third-party license terms where applicable. Webzenith will disclose major third-party dependencies upon request.
8. Permitted use & license to clients
- Upon full payment and as per contract, Webzenith grants clients a non-exclusive, non-transferable license to use the deliverables for the scope agreed in the SOW. Any use beyond the agreed scope (re-licensing, resale, distribution) requires prior written permission.
9. Prohibited acts
- Copying, scraping, reproducing, or publicly redistributing Website content for commercial purposes without permission is prohibited. Technical measures (copyright marks, watermarks, and code obfuscation for deliverables) may be used to protect assets.
10. How to report suspected infringement (Takedown Notice)
If you believe content on our Website infringes your copyright, provide a written notice to our designated agent (contact details below) including all of the following:
a. Your full name, postal address, telephone number and email address.
b. Identification of the copyrighted work claimed to be infringed (attach copy or registration details if available).
c. Exact URL(s) or location of the allegedly infringing material on our Website.
d. A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
e. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.
f. Your physical or electronic signature (an email with full contact details and a typed name is acceptable for initial reports; we may request a signed affidavit for formal action).
(These elements mirror accepted takedown practice for India and international templates.)
11. Webzenith’s response & counter-notice
- On receiving a compliant notice, we will investigate promptly. If infringement appears to have occurred, we will remove or disable access to the material and notify the party who uploaded it where possible. We may request additional evidence of ownership.
- If you are the content owner and we receive a counter-notice disputing the claim, we will follow an internal review; unresolved disputes may be escalated to legal action. We generally aim to respond to initial notices within a reasonable time (typically 5–10 business days) but complex matters may take longer. (This is a practical timeline, not a legal promise; actual response times vary.)
12. Preservation of rights & legal remedies
- Nothing in this Policy limits the right of the copyright owner to pursue legal remedies under the Copyright Act, 1957 and other applicable laws, including injunctive relief and damages. Registration of copyright (where available) strengthens evidentiary position in disputes.
